Important Travel Information & Release of Liability and Waiver
Guest Responsibility: Trip members have the responsibility to select a trip appropriate for their abilities and interests. Trip members are held responsible for being in sufficient good health to undertake the trip. Trip members are responsible for preparing for the trip by studying the itinerary and pre-departure information packets sent by Costa Rica Kosher Adventures (CRKA) and for bringing the appropriate clothing and equipment as advised therein. CRKA reserves the right to accept, refuse, or decline service to any guest before or during a trip.
Changes to the Itinerary : It is very important that you are aware of our cancellation policy which comes into force as soon as a booking is made definite. ThCRKA reserves the right to alter the itinerary and make route, lodging and activity modifications before or during a trip. Itineraries are planned up to a year in advance and unforeseen conditions may necessitate changes.
Limitation of Liability: These paragraphs (together with the Release of Liability below) define our responsibility with respect to all our trips. PLEASE READ THIS CAREFULLY. Payment of your deposit represents your acceptance of the following terms and conditions:
To ensure you are informed and aware of the potential and/or actual risks during your travels with CRKA, read carefully before signing this release. Upon completion please return it via fax or mail to confirm your reservation.

Each traveler acknowledges as follows: that Costa Rica Kosher Adventures organizes travel excursions to remote areas of Costa Rica, and that these travels requires that each traveler be responsible for his/her personal safety, health and life. Services provided in connection with its itineraries, including transportation, hotel accommodations, restaurants, and other services are purchased from various independent vendors, who are not affiliated with CRKA in any way. Although we endeavor to select the best suppliers available, CRKA has no right to control their operations and therefore makes these travel arrangements upon the express condition that CRKA, its agents and employees, shall not be liable for any delay, mishap, inconvenience, expense, irregularity, bodily injury or death to person, or damage to property occasioned through the conduct or default of any company or individual engaged in providing these services. Each of these vendors including, but not limited to, passenger conveyance companies, tour companies, hotels, and restaurants is subject to the laws of the state or country where the service is provided.
CRKA shall not be liable for: (a) expenses such as additional hotel nights and meals not specified in the individual trip itineraries which may be required either en route/prior to/or following a trip, when caused by individual clients' travel arrangements, by airline scheduling or airline schedule changes, canceled flights, missed flight connections, or by other factors not under CRKA’s control (b) expenses incurred in recovering luggage other items lost by airlines or other common carriers, belongings left behind on a trip, or in shipping purchases or other goods home from abroad and (c) bodily injury or property damage, for any reason including, but not limited to, acts of God, weather, quarantines, regulations, terrorism, war or failure of conveyance to arrive or depart as scheduled over which CRKA has no control.
CRKA reserves the right to take photographic or film records of any of our trips, and may use any such records for promotional and/or commercial purposes.
CRKA reserves the right to decline to accept or to retain from further participation any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or any person who actions or deportment impede trip operation or the rights, welfare or enjoyment of other trip members. A refund based on cost of unused land services is the limit of CRKA responsibility in such a case.
Limitation of Liability & Assumption of Risk
These Paragraphs (together with the release of liability section of the application form) define our responsibility with respect to all of our trips. PLEASE READ IT CAREFULLY. Payment of your deposit represents your acceptance of the following terms and conditions:
- By signing the Release of Liability Waiver in your Registration Form, you acknowledge that you have voluntarily chosen to participate in the provided and agreed upon itinerary, arranged by CRKA.
- You are further aware and acknowledge that foreign travel has certain risks and dangers, and that foreign countries do not have the same level of infrastructure that exists in your home country. You are voluntarily participating on the tour or expedition with knowledge that travel to the foreign countries and/or remote areas visited by this trip involves numerous risk and dangers including, but not limited to: (1) the forces of nature; (2) civil unrest; (3) terrorism; (4) roads, trails, hotels, vehicles, boats or other means of conveyance which are not operated nor maintained to standards common in the United States; (5) high altitude; (6) accident or illness without access to means of rapid evacuation or availability of medical supplies; (7) the adequacy of medical attention once provided; (8) physical exertion for which I am not prepared; (9) consumption of alcoholic beverages; (10) negligence (but not the willful or fraudulent conduct) on the part of CRKA, or others; or (11) the wild animals you may be exposed to. The travel itself, and the participation in travel activities such as wildlife viewing, hiking, trekking, boating, bicycling, zip-lining, horseback riding, boating, visits to cultural and historical sites, snorkeling, beach activities, swimming, diving, sightseeing, and all other activities involve risk and danger some of which can be foreseen and some of which cannot be foreseen. You acknowledge that you are aware of the risks and dangers and accept them. You understand that this release and waiver form cannot include all of the possible risks and dangers that you may experience on a trip in Costa Rica. You acknowledge that the enjoyment of foreign travel which takes me outside of the safety of your home and home country are, in part, the reason for your participation in such travel.
- As well, you understand and acknowledge that foreign travel in an underdeveloped foreign country is in remote areas without access to adequate medical facilities or doctors. Inherent risks of illness, including but not limited to malaria, may result from travel in underdeveloped foreign countries. You understand that medical evacuation expenses may be incurred if you become injured or ill and that you are solely responsible for payment of such expenses. You also assume responsibility for prevention of malaria or other illnesses particular to the geographic area you will be traveling in.
- Neither Costa Rica Kosher Adventures, nor its agents, shall be responsible for circumstances arising as a result of acts of God, weather, high altitude, detention, wildlife behavior, annoyance , delays and expenses arising from quarantine , strikes, theft , pilferage, crimes against persons, military, political or terrorist action, civil disturbances, government restrictions, failure of any means of conveyance to arrive or depart as scheduled , or discrepancies or changes in transit over which there is no control.
Traveler’s Statement: I agree to take full responsibility for my own welfare and the welfare of my minor dependents traveling with me.
I herby state that I have my own health insurance for traveling abroad, that I am in good physical condition, and that I have been advised by CRKA to seek the advice of my doctor concerning vaccinations, medication and the medical and health risks associated with this particular adventure.
I acknowledge that Costa Rica Kosher Adventures STRONGLY advises that I take out trip cancelation/interruption insurance and that is my responsibility to obtain the insurance.
I acknowledge that I alone am responsible for obtaining passports, visa, health certificates, travel insurance or other travel documentation that are required or recommended for my travels. My passports will be valid for the appropriate amount of time and have the appropriate amount of blank pages required by Costa Rica.
I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE, AND ACCEPT ANY AND ALL RISKS OF DELAY UNANTICIPATED EVENTS, ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH.

I acknowledge that the cost of CRKA trips have been based upon trip participants executing this Release of Liability and Assumption of All Risks.
I agree not to hold Costa Rica Kosher Adventures, its owners, employees, members, shareholders, agents or representatives liable for any loss or injury, expense or damage, whish result directly or indirectly for any act or omission by Costa Rica Kosher Adventures or any person of firm which provides goods or services in connection to Costa Rica Kosher Adventures. Moreover, I agree to assume all risk pertaining to travel, agrees not to sue Costa Rica Kosher Adventures and to hold CRKA harmless from any personal injury or property damage arising out of travels with Costa Rica Kosher Adventures. This waiver and release of liability includes any and all claims for personal injury or property damage whether arising in tort, negligence, contract, equitable claims or any other legal claim statue under statute or common law. Neither, Costa Rica Kosher Adventures, nor its owners, employees, members, shareholders, agents or representatives, shall be responsible for circumstances arising from quarantine, strikes, theft, and pilferage, military, political or terrorist action, civil disturbances, government restrictions, and failure of any means or conveyance to arrive on time or at all
I intend the foregoing waiver and release of Costa Rica Kosher Adventures to be as broad and inclusive as permitted by law. I also acknowledge that I am not relying on any oral or written representation of Costa Rica Kosher Adventures regarding safety, and that I am entering this agreement of my own free will.
If any part of this release should be declared unenforceable by operation of law, then it is agreed that those portions whish remain enforceable under law shall remain in full force and effect.
It is further agreed that any controversy or claim arising out of participation in a Costa Rica Kosher Adventures trip and/or this release, which cannot be resolved amicably, the following conditions will apply: (a) the dispute shall be settled by binding arbitration through the American Arbitration Association in Los Angeles, California; (b) the dispute will be governed by California law; and (c) the maximum amount of recovery to which I will be entitled under any and all circumstances will be the land cost of my trip with CRKA.
Voluntary Execution: My signature below certifies that I have carefully read and thoroughly understand the contents of this Release of Liability, Waiver of liability of right to sue, as well as the content of the Costa Rica Kosher Adventures Terms and Conditions and other advisories, particularly those regarding cancelation and refund policies, limitation of liability and responsibility borne by trip participants. On the advance of a deposit to Costa Rica Kosher Adventures, the depositor, his or her family and heirs, agree to be bound by the above Release of Liability Terms and Conditions.
I understand this is a legal binding and enforceable contract and I sign it of my of my own free will. The consideration for this legally binding and enforceable contract is the travel, travel arrangements, and itinerary provided to me by Costa Rica Kosher Adventures.

Either parents or guardians must sign for child under 18 years of age. By signing this document for minors, the parents or guardians not only agree to release and waive liability for any injuries to the minor, but the parents also agree to indemnify and reimburse Costa Rica Kosher Adventures for any liability or damages incurred by Costa Rica Kosher Adventures should the release and waiver on behalf of the child be held unenforceable or invalid by operation of law.
Terms and Conditions & Insurance Waiver
I understand fully that there are non-refundable expenses involved in preparing for a trip such as the one in which I plan to participate. I have read Costa Rica Kosher Adventures’ Terms and Conditions for this trip, noting and accepting policies regarding trip cancelation and refunds, Costa Rica Kosher Adventures release of liability and my own responsibilities
It has been highly recommended by Costa Rica Kosher Adventures threat I purchase insurance (accident, medical and trip cancelation insurance) appropriate for my entire trip. I am aware that if I have pre-existing condition I need to purchase a policy before or within a short time (i.e. 10 days) after making a deposit (depending on the specific policies) in order to be covered for that specific condition.
